Dodgy eBayer

Take a look at this:

He sells these models for a very high price, problem is they are epic scale, but try finding that in his descriptions, it takes a while. He has already been removed from eBay twice under different names, one of which was terrencestephens (i think) and now he\'s back with more bollocks.

Over on a wargaming group on eBay we had a very difficult time getting eBay to ban his last user account and pull his auctions. Any support from people over here would be greatly appreciated. I dont really know how to complain to eBay and take action, but i know people here do.

So please help, because i know i would be annoyed if something i pay a high price for was only epic scale.

Anyway, I don\'t see anything wrong with his prices.
He may not say \"epic\" but he doesn\'t say Warhammer 40,000 either

Problem is the stuff goes for a hell of alot more than it is worth, then he \'disappears\' when people request a refund.

*EDIT* He does put epic in the description, but its one line in a huge block of text. It took me two reads to see it.

they are listed in the epic section so he is not breaking any rules.

he is just relying on people thinking they are getting a bargain and not fully checking what they get.

ebay won\'t do anything about it as he is following there guide lines.

Thats exactly the problem, last time he was on somebody had to follow everything he was doing in order for eBay to stop him. It took months to get him removed.

i\'ve seen dodgier stuff. the best was a whole page about an ipod (with the title being, ipod, cheap! or somehting like that) with pics and facts about it as if it was what he was selling. then in teeeeeeeny tiny text at the bottom was a line saying:

\'this auction is not for an actual ipod but only the information about where to get a cheap one\'

saw several of them going for about £100 or so. bet the people who got them were gutted

Yep, have come across this before, was a pain in the arse but I contacted his highest bidders and informed them what was what, and funnily enough they all retracted bids!

There is a guide to this scam actually on ebay, but as said, he is listing correctly and not breaking any rules( although being a c**t is a pretty big break of the rules of decency in my book...)

The thing to remember is that if something looks too good to be true then it probably is. Don\'t bid if unsure and if there aint a picture then smell a rat.

Alot of people have bidded on the items already, so iv sent them all emails warning them of his \'con\'. I will continue to email people because i would hate to see people getting ripped off by that a***hole.

That sucks. I actually know a guy that was banned from ebay for selling links to xbox360\'s website for the price of the actual console.... links people... for 400.00 dollars a piece. Sold 4 I believe before he was jacked off the site. He followed the guidelins and again the small print at the bottom that no one takes the time to read....\"this is not the actual product but a link to the product page, blah\"

This is really sly :flame: Just goes to show that you really do need to read everything. Its sad that you have to be weary of sellers but he does have 0 feedback.

this seller i came across doing the Epic scam stated that if bidding reached over£30, he would ship registered at no extra cost. The Epic squiggoth costs £15 new so this was only said to try and lure people into thinking it was a 40k scale.

Well he\'s listed in the epic section, and he does state it\'s epic scale in the body (not hidden with small print or anything).

Once you bid on it, it\'s a contract. The only way for the bidder to get out is to claim that he made a mistake... but...

ebay is a user to user community mostly, not a business to user. So everyone is supposed to be on an equal footing.

In this situation it\'s not the seller\'s responsibility to scream to the bidder what scale the figure is in (as long as it\'s stated in the terms), or even try to guess what the bidder was thinking about when he placed his bid.

If, as a bidder, I made mistake like this it\'d be a unilateral mistake (i.e. one made just by one party, me) and since we\'re on equal terms it\'s just too bad for me. Contract theory is that if I didn\'t bid, he\'d at least have had a chance to sell to someone else. It works both ways, a winning, subjectively too low, bid has to be honoured, as does a winning, subjectively too high, bid.

The only exception would be if the seller knew or should have known I made the mistake, e.g. I enquired and said, wow what a cheap 30mm scale miniature and he said nothing and let me continue to bid on it. In that case I could back out because he\'d be on notice that I\'d made the mistake.

It\'s a bit of a stretch to say that he should have been put on notice that I made a mistake simply because of the price I was prepared to pay for the figure. This is ebay, an auction site, after all, and stranger things have happened. If I were allowed to argue that I\'d be able to back out of any auction for higher than retail value.

There\'s nothing misleading here, and I spotted \"This is epic scale\" almost immediately in the description of the text.

Read everything before you sign it, and read everything before you pay money over. Caveat emptor.

After all, if I was really trying to buy an unpainted, unassembled 30mm Vindicator for 2 quid, I was trying to get a great deal too. It\'s not the bidder\'s job to tell the seller how much something is really worth (omg, antique roadshow, I got it for $10 at a yard sale and it\'s worth $10,000). In the same vein it\'s not the seller\'s job to do so either; he just puts a sticker on it, and I pay it if I want it.

This was terrancestephens who was eventually banned by eBay due to work from members in the gaming group on eBay.
