Ebay sellers GW watches you !

This is what I discovered when my latest auction was stopped by E-bay...
GW has a service dedicated to the ebay survey and when they think your item doesn\'t copy with \"their\" intellectual property, they force ebay to suppress the auction or even SUSPEND your account forever !!!

So take care of what you say or sell !
Actually my mini was Salauel from Rackham and was called \"Confrontation necromancer warhammer\"
In the description I said it was made by rackham but could fit also in your Warhammer army...
Nothing special for me, but it seems that you are not allowed to think or do that....
Meditate ???

I just wonder why we couldn\'t do what we want with second hand painted products...
Anyhow I have just reposted this auction giving full and only credit to rackham, after all let good stuff be played with good games ;)
Since Ebay is a major income issue for some of us I just say :

You could use:

Made by Rackham. Not manufactured by GW or for official use in Warhammer.

GW cannot complain about the above, which is perfectly true.

However, eBay may not be too pleased since it\'ll still screw with their keyword searches :)

Heck, I get frustrated enough looking at the wrong minis because someone has misnamed them purely to get more views.

The one that really gets me is this: Do a search for warhammer pro painted and see how many of the \"Pro painters\" you think can feed themselves on what they earn with those skills.
Half of them are half-assed thick paint slopped peices of crap. I don\'t mind them being sold, since I can strip and use the mini, or someone else may just wish to game with them, but when I want something well painted I don\'t want to wade through the hordes of morons who can\'t understand the \"pro\".

I think the problem they had was with the 3-word title.
You could title it \"confrontation necromancer - better than Warhammer\"
or some other way of inserting words to distinguish it.:D

I\'m not sure why anyone would look for \"pro painted\" as a key word now. It is clearly overused, and with results like you describe, you may want to search painted \"-pro\"

Anyway I always add a gallery picture of the model so the ebay members can sort easily the auction, and stop on it if interested...

For the \"pro\" mention, it\'s true many sellers over use it !!!
But honestly my ranking on this site is 8.33 with my top mini at 8.6... Many full time painters (hence \"professional\" ones get lower scores...

Well....I wont worry till they start having the balls to say you can`t sell your converted and painted minis as it takes money from what they could be selling at ther high azz prices....lol,just another reason to do converted stuff useing only gw product....they can`t stop you from selling your work....ass holes,would like to,but they can`t do that....as much as they would love to see all non gw games die....they don`t control us.

So use there products to convert and paint....but play other games and they will leave you alone,lol!

In other words,use them,like they have used all the kids....make money off them,and do it legit,promo only there stuff,and use there stuff...so when they try to stop your auction they are made to look like fools...\"Uhh we don`t even want you to sell our stuff,we want all the money,even after you paid for our basic products,you can`t resale it\":rolleyes:

in my auctions. I hope that the quality is good enough to use that term. everyone used to tell me I should paint pro. You tell me?

My advice?

-Don\'t use \"pro-painted\". It\'s widely considered a joke now. You don\'t see Jennifer Haley, Vaitalla, Jarrett (aka Shroud), or Sorcerer Studios using \"pro-painted\" in their titles. Veteran buyers now consider it the tool of a desperate first time seller.

-don\'t mix \"warhammer\" and any other company\'s product name in your title. eBay calls it \"keyword spamming\", and it\'s enforced on occasion. Just because you got away with it once or twice doesn\'t mean your auctions won\'t be yanked eventually, and your account suspended. Some people have gotten around this by including some warhammer product in the auction, along with the model. You\'ll occassionally run into an auction that justifies using the warhammer name by basing the model on a warhammer base, or even just throwing in a warhammer base into the auction. The reasoning there is that since a warhammer product is part of the auction, you\'re justified in using the name in your sales title.

Heck no. If you have the talent (as you obviously do) but aren\'t technically \'pro\' then there\'s no real damage done. What gets me is when the \"Pro\" has dipped a plastic marine in textured emulsion and whacked it up. }:D

It doesnt matter how you phrase the title, if you use a GW trademark they can and will pull your auction. I had a scenery auction cancelled and it was listed on ebay as \"Warhammer figure plus free scenery\". The figure was visible in the pics placed on the scenery piece.
I contacted the GW solicitor and he said it was fine to use Warhammer Style or suchlike in the description, but not in any way in the title. I even mentioned that i sold scenery and terrain to fund buying GW figures, but he didnt care about that. I wouldnt mess with GW as they WILL have your ebay account suspended if you post using their trademark again.
Love GW stuff, but hate their corporate asses.

I\'ve dropped the \'pro\' prefix and just stick with \'painted\'. Like a lot of folks I feel I can use the term \'pro-painted\' legitimately, but there is a lot of crap out there being sold under the same moniker which does detract from the good stuff out there!

I can see the problem with including certain keywords in a title for something that isn\'t really relevent to them! It can be annoying to see things listed as warhammer or 40K when they\'re by a different company. However, GW\'s involvment in getting those auctions ended does have further ramifications as has been intimated at already (though they have a good point if Void minis are being sold as 40K!). Is it conceivable that they could take steps to try and end auctions and sales of things that they deem to be not in the best interests of the company? The second hand market is taking money out of GW\'s pockets, as it does with any provider of goods be it CD\'s, books, or whatever. Converted GW minis that utilise parts from other manufacturers could possibly be cause for concern, or even just scratch built parts and minis that are listed as warhammer. Maybe even a simple painted figure that isn\'t painted to fit in with the GW style. Could all these things be deemed as not being in GW\'s best interests?

A bit extreme perhaps, but big companies can get funny ideas at times! Look at footballers over here in the UK who have \'image rights\'. If they don\'t give the right to print their photo then whoever does so without permission gets taken to court!

GW probably won\'t go all Big Brother on us, but it makes you think!

dude i to am p****d with half of those people on ebay that catch your eye with the words pro painted because it kill\'s it for the real artists like us that are trying to make a living out of it, my message to all the tallent killerz out there are\" please put the word NOT infront of pro painted for the love of god theres enough crap on there already to shift through with out going through false painters stuff as well, so kids and killerz alike \"LEAVE THE PRO PAINTING TO THE PRO PAINTERS!\" :flame:

Watch the title

I recently had an auction yanked by the Evil Empire\'s Legal Geztapo. It seems that they objected to the title PAINTED Orc Champion Reaper/Warhammer/D&D on the grounds that the miniature was not made by them, and therefore the title was misleading and attempting to \"acquire value by misrepresenting Games Workshop copyrighted products\".

Okay, basically what it boils down to is that it is okay to say \"Suitable for warhammer, etc\", but not to infer in any way that Games Workshop has anything to do with the actual production of the auction item. Whew, what a legal anality!

Anyways, I reposted the item and things are going well now.

And they wonder why they are referred to as \" The Evil Empire\"?

e-bay and GW

hey gang,
to Taban, you can\'t multi list to start with. the gw/confrontation/d&d isn\'t e-bay legal. i beleive you are allowed one reference for your goods out of it\'s category.
so d&d 40k works, add the 3rd manufacturer and your out!! this is e-bay\'s rule not GW.
for the terrain, only GW terrain can be listed as such. don\'t list it as warhammer terrain when your going to post it to the warhammer category codes anyway.
the 31399 or 31400 category codes should get you into the wahrmmer searches as that\'s the category it\'s posted in.
i\'ve never had one shut down and have over eight hundred e-bay trades!
