Hi guys, i recently started painting a chaos leman russ, and i used some paintings found on the internet as decoration on the sides. Half-way through the project i started to wondering if im enfringing on copyright laws and/or blowing my chances for a demon statue?!? Can anyone shed some light on the matter?

I guess it depends on the images and wether or not they are copyright protected.....Never heard of it happen before....seen allsorts of references used...
Blowing a demon will only really happen if it conflicts GW\'s intellectual property...

if you have pics of what your doing that may help get better answers..

Something that could affect your chances in a Golden Demon competition is if the imagery you\'ve used doesn\'t fit with the 40k universe.

Which pictures did you put up? Links?

I\'m thinking that if you aren\'t using the pictures for a commercial purpose, and will be keeping the mini rather than selling it, I think that\'d fall under the fair use.

But I think Ritual has a much stronger point than any copyright worry.

I heard that Yellow one\'s Revenant Eldar Titan didn\'t place because he had infringed on Geigers copyright with the freehand.

Well, that\'s not right. He did place. Got bronze in the Open that year.

As soon as a work is \"...fixed in a tangible medium...\" it is covered by copyright. Registration mainly goes to statutory damages. There are lots of factors on whether it infringes, commercial harm only being one. Biggest issue you would have is whether the copyright holder would bother with legal action considering what you are doing and the legal costs involved. I highly doubt Yellow One\'s work could be said to infringe unless he directly took a piece of Giger\'s work. Styles/pure ideas can\'t be copyrighted otherwise there wouldn\'t be expresionist, neo-classical, impressionist, realist painters.

Here\'s a decent link on a similar topic.

Helps answer the Yellow One statement as well. Pretty much comes down to you won\'t know if it infringes for sure until it gets litigated, so you just have to do cost/benfit for yourself.

I haven\'t got a link, but the artwork that I used was originally painted by hieronymus bosch, will post some pics when I\'m done, it will be easier to tell from that than just a discription..... Thank you:beer:

Well, I think you\'re safe from Bosch taking you to court. Also it\'s not uncommon to see art students in a gallery copying paintings that are hanging on the wall.

I\'m pretty sure that a few years ago someone did try to use Bosch\'s imagery on a GW vehicle in a Deamon comp and it bombed.
lono might be able to shed some clearer light on the matter, try PM\'ing him.

I think someone already hit the nail on the head, it needs to fit into the GW world of Imagry for Warhammer 40K and if it doesnt it wont do well. I could paint the best Soryama copy on a rhino and its going to bomb as it has nothing to really do with that imagry. Now Hieronymus Bosch\'s influance was heavily used in the development of the Mordheim World and drawing from his work might work in a setting like that.
