Looking for Brian Collazo...

Hiya - does anyone have any way of contacting Brian Collazo? He\'s gone awol on a client of mine (who sent him some army stuff for the very cheap painting) and hasn\'t replied to emails since last year. Thought there might be someone here who has some idea? Like, maybe he\'s unwell or something?

I\'m not actually involved in this in any way, but got an email from the client last night who really has no idea how to proceed and at this point just wants his models back. It\'s an international job too - client in Australia, painter in the US I think. Unfortunately the client doesn\'t have a copy of the contract he signed - the document, yes, but not the actual one with his signature.

Actually, how *would* one proceed internationally? I do almost all of my work for people in the States (I\'m from NZ) and I\'ve only once or twice had someone flake on me but at least in those instances I\'ve still got the model - it\'s actually more frustrating when someone confirms for about a months worth of work and then pulls out at the last minute, leaving me scrambling to fill the gap...

Anyway. If anyone has any idea how to get hold of this particular painter it would be nice to know - perhaps he\'s changed his email address and forgotten to let all his clients know.

I would tell your friend, to keep contacting him and to point out a few things in the contract eg.:

Non-Performance Penalties

The following penalties will be imposed on iPAINTminis for not performing the requested Services in a timely fashion. Penalties for non-performance of the Services within the “specified completion time removed” Contract period are as follows: 22-30 beyond expected completion date days will result in a 30% discount of Service amount. Greater than 30 days will result in a 50% discount of service amount. Greater than 45 days will result in the Service being provided at no cost to the Client and a return of any Additional Compensation.

That would result in free of charge, if he has waited 6 months! Why anyone would put that in a contract, is beyond me...

Notice

All notices, requests, demands or other communications required or permitted by the terms of this Contract will be given in writing and either served personally, by email, or by registered mail. The addresses for any notice to be delivered to any of the parties to this Contract are as follows:


Client Contact Information
Brian Collazo (iPAINTminis), to be provided
Emergency Contact – Client
Emergency Contact – iPAINTminis


or to such other address as to which any party may from time to time notify the other.

Who is the emergency contact, and doesn\'t this mean that the client should have Brians home address ? You could look it up and give him a call for him ?

Enurement

This Contract will ensure to the benefit of and be binding on the heirs, executors, administrators and assigns of Brian Collazo (iPAINTminis) and upon the successors and assigns of Client.

Should be enough to take to further if needed. But it IS a great problem that he doesn\'t have a signed copy, wich from his side, was very stupid...

In the event that iPAINTminis must terminate the Contract. Written explanation will be provided to Client and ALL models, including Additional Compensation items will be returned at iPAINTminis’ expense.

Again...

Governing Law

It is the intention of the parties to this Contract that this Contract and the performance under this Contract, and all suits and special proceedings under this Contract, be construed in accordance with and governed, to the exclusion of the law of any other forum, by the laws of the State of Illinois, without regard to the jurisdiction in which any action or special proceeding may be instituted.

This makes it legal to follow up in any country out there, regardless of bylaws. So it should be no problem bringing this further, considering you can figure out where he lives.

Well, if but anything you don\'t get your clients money / minis back, at least this guy won\'t get any customers again... At least not from Cmon :p

Good luck to your client, this is truely sad...

Just a last thing, I would check his E-bay profile, and try to get a hold of him there. He last used his profile on the 6th of June, so he is deffinatly still \"alive\" and well... linky

Thanks for that! I\'ve emailed the client your suggestions as well as a linky to the US Whitepages results for B Collazos in Illinois. I\'m just trying to help him out - I don\'t think I\'ll be making his phonecalls for him :)

It\'s very nice of you... Buisness can be a pain, specially when it\'s not done by a company but just by people. This just goes to show, that a contract is fine and makes it look very prof, but in the end it doesn\'t really matter if you end up without a signed copy!

Hope he gets a hold of him. Again, I\'m sorry to hear he got stiffed... Some patience he got, 6 months... damn... :)

Were about in Oz does he live. If hes in QLD tell him to get a few more minis and I\'ll paint them for him for very cheap. Depends on what quality he wants and what type of minis. Always willing to help a fellow mini collector/Gamer.

If that\'s the same Brian Collazo I know he was last I spoke to him posted to Iraq I believe (this was a while ago tho, and way before he started a painting service (he was doing some paint-ups for my website tips section). We sort of lost contact because of my illness and he stopped responding to my emails too, although they perhaps never got to him because of the fact he wasn\'t near a computer during his tour of duty.

I unfortunately don\'t have any contact details aside from his email which I\'d assume you have since you\'ve been emailing him, but just in case its a different one its:

PS: On a law note (although I studied English Law, its very similar) the contract, so long as both parties agreed, it legally binding (it constitutes a verbal contract) and I\'m sure (Brian seemed like a really nice guy) he\'ll sort it out, I think he\'s probably been reposted to Iraq or something and forgot/client didn\'t get message?

I\'ve tried emailing through Ebay and PP for you, giving Brian the address for this posting - Try PP for the address (although I\'d say good luck, unless you paid via PP).

It is now (after checking Ebay) definitely the same Brian as I know.

Thanks for that info - I\'ll pass it along (like I said, this is not for me - I paint miniatures fulltime so am not about to be commissioning cheap stuff from anyone else!) as well as the email address in case it\'s a different one.

Hi, i am the client involved in this situation. Thanks for all of your help and advice guys, i really appreciate it.
He has contacted me with a fairly detailed reason for what has occured and i believe it, even if i am still fairly disgruntled by how long things have taken for me to find out the situation. However, he does seem to be trying rectify the situation, so i don\'t think he needs to be put to the gallows over it.
I\'d especially like to thank Rachel for her help, she did a great deal more than i could hope for.
