For $100, I can make sure they never find out.

Seriously tho, should they find out that you\'re trying to market it as a GW piece, yeah they\'ll probably throw a fit. Sculpting one for yourself, they might only pull out the nasty letter.

If you could get it enough distance away from what they\'re doing, such that it didn\'t infringe upon their trademarks, you probably could get away with it.

It\'s a bit of a no-brainer, isn\'t it? Imagine what would happen if you sculpted Donald Duck figurines and sold. How long would it take until you had Disney\'s lawyers all over you?

There\'s been quite a number of cases when companies have had to pull minis from sale because they\'ve been similar to GW artwork or imagery. Usually it\'s within weeks of releasing the mini.

It\'s called IP infringement and it\'s against the law (in most countries)!

If you go to far away places in the world, you\'d see Donald Duck being sold with Disney unable to do anything about it. However, if you live in a place where people can be tracked...watch out! Of course you could always do what scalpers and pimps do...just hang out in the street corner and GW will not find out.

Oh, if you already have one. PM me and I might be interested...I won\'t tell GW either.

You can of course be inspired by it for a miniature... but no exact copies and stay away from replications of iconic GW stuff like Space Marine armour...

yeah they could screw you right over!

where would you stand if you wanted to sculpt a model based on someone else\'s artwork. say, from a piece from conceptart.org?

The only difference, AFAIK, is that a random, unknown artist posting at conceptart would not have the legal or financial muscle that GW has. But they do have the rights to their work.

Check out the rights on the stuff on conceptart, they may be covered by CC (creative commons) which allows certain things to be done (all my stuff on flickr and my site is covered by this) it can stop people making derivative works or encourage them as long as the original artist is credited etc... (which is what I think a sculpt of a concept would be)

If you make a load of money off something that is blatantly based off a piece of artwork that belongs to someone else they have every right to sue your arse off. Haven\'t you ever seen that episode of the Simpsons where Chester Lampwick invents Itchy and Scratchy? lol

All you do is ask moronic, senseless questions about things that you will never act on and thus deserve no kind of answer. I just did some sick in my mouth. And yes, I have started drinking again thank you very much!

All the above said there are people that do it...

I mean there are those figures of the Emperor Horus and Sanguinius.. almost exact copies of The artwork...

Even Enigma has the Morphus guy that is from the Hordes of Chaos art of Corpus Festerheart.

they soon clamped down on JMD for the Daemonette.. yet loads seem to get by that are blatant rip offs. (inch high anyone??)

They clamped down on that too, and it got changed. Not much, but enough so that it didn\'t resemble the artwork in detail.

it\'s also the countries that people are trading from.
the authorities in some countries don\'t care and therefore it\'s easier for people to get away with it.

you are not supposed to, but then GW stole its power armor design. namely the helmets, from Star Wars Stormtroopers....

with all the IP GW steals from i don\'t see where they really have a leg to stand on. whats next after attacking online bitz sellers, suing WotC for making Star Wars minis because it has Stormtroopers that look like space marines?

you should do some research on \"fair-use\" or its equvilant in your country of origin.

there are of course many ways that would allow you to sculpt and sell small quantities of a mini based on GW artwork, but i wont get into that as you need to understand the fair-use information as best as possible first.
