My webmastering teacher will be happy to know that some of the lessons on copyright actually sunk in while I was surfing the CMON site lol

The signature is from an Auto-sig maker and is hosted on Warcraftrealms.com. The background is copyrighted by Blizzard Entertainment, and the use of it for the auto-sig maker was approved by Blizzard Entertainment. (Though the site is also a forum so for legal reasons they are not endorsed by Blizzard Entertainment as they cannot be held responisble for views expressed on the site):D

Originally posted by MickMing right the copyright would remain with the sculptor unless he was supplied with a image to go by
That\'s a bit more complex but in fact the copyright on the sculpt itself still belongs to the sculptor since that\'s the person who created it. But the copyright on the design is not his, so for certain uses he still needs the design copyright owner\'s owner\'s agreement. But his own permission is needed when you want to reproduce from the sculpt.

In the same way, if you make a photograph of a miniature you have several copyrights owners; photographer, painter, sculptor (or whoever bought the right) and designer. Each of them could demand the photograph to be removed when found on internet.

Anyway, this is how I understond the copyright law in a general sense (even with Bern there are still some differences between the application in different countries). I\'m not a lawyer but I\'ve been in several discussions on the subject. If you want to have legal advise you could try Bob Lippman since he\'s both a sculptor and a US copyright lawyer.

I think Ming pretty much how its handled here and abroad its a given once the green is bought you can basically do as you will with it..I guess some sculptors might want a contract this specific as you mentioned but i havent ran across any yet..only one of all the people we have delt with have even mentioned a contract..most just want more work and not headaches for themselves with nit picking over the details.now i do think basics should be laid out so everyone concerned is happy with the details like amounts paid due dates and such...now i know some sculptors wont remake minis they have made like alternates and some sculptors will..I think if the sculptor is overly concerned over their work for whatever reason they will have problems judst my 2 cents

Er Mick, I think we are drifting off the subject. :)

The reason I explained all this is because I wasn\'t sure how much you know of copyight laws (there are lots of misunderstandings around) and I would hate to see you running into legal problems because of it. Or see somebody run of with your design because it was not protected.

Sculpting contracts are a different subject as are common practises. I\'m still studying those as I\'ve found out there are several which are considered common by different people. Will take a while but I intend to get more info together and post it on sculpting boards so people know of them.

Ming yeah the version you are presenting is the techinacal one i agree but you will learn there is alot of give and take in what we do once you start producing the magpie minis..prime example a miniature we have now is actually past the due date but not being the anal type i want the miniature so i dont mind it being a bit late and the sculptor appreciated me not being a grump about it and understanding..that said lowered the final price and we are both still happy ..so my point is you will learn that its best to cover your bases but theres people who will work with you beyond contracts and due dates..flexibility being the key.;)

Ming i actually could post one with out any names and dates and let you see the one we have that was drawn up ..this thing could be discussed very in dpeth so people are clear on things so they dont go into a hiring or sculpting job without some knowledge.

Yes, that would be usefull I think. That way other sculptors can look over it as well. I can also take it to 1listsculpting if you like and see what the professionals over there have to say about it. We already have a rough guide over there which was set up by Bob Lippman.
