That\'s a bit more complex but in fact the copyright on the sculpt itself still belongs to the sculptor since that\'s the person who created it. But the copyright on the design is not his, so for certain uses he still needs the design copyright owner\'s owner\'s agreement. But his own permission is needed when you want to reproduce from the sculpt.
In the same way, if you make a photograph of a miniature you have several copyrights owners; photographer, painter, sculptor (or whoever bought the right) and designer. Each of them could demand the photograph to be removed when found on internet.
Anyway, this is how I understond the copyright law in a general sense (even with Bern there are still some differences between the application in different countries). I\'m not a lawyer but I\'ve been in several discussions on the subject. If you want to have legal advise you could try Bob Lippman since he\'s both a sculptor and a US copyright lawyer.
