Bank Holidays (UK) question

Dont know if depends on what industry you work in.

But for us common or garden folk, if i don\'t want to work a bank holiday I can\'t be forced. They are mine by law.

i think bank holiday refers to those on a monday wheras the others are public holidays. both are classed the same though workwise i believe

It\'s an interesting one.

The company I work for suggests we\'re entitled to them contractually, but we\'re unsure what that means for us on any given UK holiday. I\'m perusing GMB, TSSA, company policy and my contract. No-one knows the score :wow:

I think that means you\'re not supposed to work on those days and therefore can\'t be required to (either by direct instruction or innuendo / \'subtle\' hint).

So if you choose to work on one it\'s overtime; then you have to decide on the OT rate if you have more than one - usually same as weekend or Sunday rate, if applicable. Triple time! :)

More like, as I suspect reverend works for an outscourced contract company they will be working on a \"Time Off In Lieu\" instead of wages.

I\'m not sure on the exact state of the law in the UK any more as the EU has messed about with employment/employers requirements. You\'d need to consult with someone \"In The Know\".....typically our Trade Union rep has left for the day, so I can\'t check.

Yep, GMB. Same on that site as TSSA.

Looked further into my contract and I have 25 a year normal days (4yrs of service coming up) and 8 public/bank holidays each year (\'entitled\' as they say).

Our HR policy says:

\"For the majority of full-time employees who work a standard 37 hour week – Monday to Friday, Bank Holidays are not included in the normal holiday entitlement. When a Bank Holiday occurs, time off work with pay is provided if the employee is not required to work on that day and is entitled to that particular Bank Holiday.\"

However, some full-time employees work a shift arrangement or unusual working pattern which means they work different hours on different days of the week. It may be more appropriate in this case to incorporate Bank Holidays into the normal holiday entitlement calculation (similar to the part-time calculation below). In this case, the employee must deduct the number of working hours from their holiday entitlement when a Bank Holiday falls on a normal working day.\"

Whilst I fall into the second paragraph for purpose of shifts, we don\'t have combined leave to cover annual leave and bank holidays, so are deemed as a separate \'entitlement\'.

The other issue we have is regarding being \'required\' to work. If ytou think about it, everyone would normally be required to work if a bank holiday falls on a day they normally work, yet the majority of 9-5, Mon-Fri sorts in the office always get the holiday whereas shift-workers don\'t whilst our contracts are ostensibly the same.

I\'m feeling a militant moment coming on....... :cussing:

I\'m an ex union rep (TSSA) and this bit sounds like you\'re having holiday entitlement reduced because you\'re rostered to work a bank hol.

My current job often means I work bank hols but I get the hours credited to my holiday entitlement.

It looks like the way it\'ll be here too, the lieu days totting up and being used later. It\'s all about clarity, as the company is a right one for moving goalposts...

Interestingly, when on-call (one week a month at the mo), we\'re eligible for a lieu day by dint of being on-call on a Bank Holiday (should it fall so) even if not used. Not a bad arrangement at all!

Wow, it\'s taken me 20 years to get 20 vacation days, plus 8 personal days.

Although we do get the \'major\' holidays off...Christmas, New Years Day, Thanksgiving, 4th of July, Labor Day.

If we have to work those days, we get double time and a half....
Of course, those are all union negotiated privileges, with a private firm.

Our government only sets down rules IF you are a government employee.
