Otter, show me who/how your gonna legally enforce a painters Ip on a mini they sold on a public auction site?? name me the established legal case that sets precedence for this case?!?

Sorry, lost track of this thread for a few days. Snowdog, there\'s a HUGE copyright movement that got a lot of momentum with the Web. I am sorry for the following \"lecture mode\" but copyright infringement is a big pet peeve of mine, as I keep finding my stuff (sadly, not the minis! lol ) posted under other peoples\' names.

I don\'t think anyone could show you this type of obscure case, because copyright infringement over the Internet or via auction houses are usually settled out of court. All it usually takes is to buy the services of a lawyer, have them trot out some legalese, and settle the claim. It might be a unique event to have pitynoman go after this kid, but he most certainly has the legal precidence to do so should he choose. The only problem is that the $2k paid to the lawyer to get back $500 is a little on the sucky side.

All things considered, it\'s actually a pretty good time to be an artist. There\'s a lot of places capitalizing on it, the bastaches, but there are countless art-centered communities that are working to help inform artists free of charge. This is a decent general guideline.

We\'ve got rights, and we\'ve got a lot of them. We just need to excercise them more in the international forum. I think it would be a good idea if this site helped the cause by creating a list of iron-clad terms of use and copyright standards for its members and visitors. There is a notice of copyright, but it\'s listed far at the bottom of the conditions of use. This site provides a huge service, however, just through giving the time/date stamp alone.

Secondly, it is not a mold line.

Ms. Haley is trying out a new technique. NMML. I believe they discussed this on superduperpainters.com. It is No Mold Mold Lines.

She has actually simulated painted a mold line, where one used to exist. Quite remarkable, really.lollol

This NMML term is new to me. I\'ve always heard of it referred to as Phantom Mold-Line Simulation, or PMS. lollol

Hmm... My wife uses this \'PMS\' technique quite a bit, and yet she hasn\'t picked up a brush in years......that is odd.lol

mold lines are funny things.

you can swear there is no line. but then you go put it under bright lights and photograph it then blow it up %300 bigger and there it is.

i couldn\'t for the life of me get a decent photo of a demonette i painted. there was always this little bright spot on the leg. but i never did see what was making it.

Best way of spotting Mould lines is to give the model a wash of thinned down black ink before you prime it. It\'ll take the shine of the miniature and makes it real easy to spot anything you might have missed.

Just a handy little tip for any Slayer Sword winners out there... lol

I usually find them after I do an initial prime - they stand out for the lack of paint behind the line.

 Oh, so that\'s what I\'ve been doing all these years! I have a gift for this technique myself...<sigh> I tried posting an article to superduperpainters.com, but they do not yet recognize this as a valid technique with artistic intent.

Really! It\'s a subliminal symbol focusing on the inability of any artist to achieve a true encompassing union with the intimate creation evolved in the existing smooth medium.???

Honest. Now why won\'t they believe me?

:rolleyes::rolleyes::rolleyes:

Sorry to hear that this happened.

I do this that they should say something in the White Dwarf about it.

I\'m not surprised at how much parents let their kids get away with. Some even help them. I saw a year ago on 60 minutes where this entire class plagiared their term papers. The students claimed they didn\'t know what plagiary was. The parents defended their cheating kids, pressered the principle to keep the kids passing grades, and harassed the teacher so much she quit her job.

I believe Roger Waters (ex Pink Floyd) wrote a whole song about what an \'alien anthropologist\' would make of us lot. Damn fine record, even if I can\'t recall the exact track name...:D

Edit. \'Amused to Death\'..as in the alien anthropologists conclusion...\"This planet has amused itself to death...\"lol

My take on this little

First off, I am truly sorry that your mini was misrepresented and won a golden daemon without the credit going to the rightful painter. With that being said, on to my take...

I agree with Big Mean Elf, beat the tar out of that little bastard and also his parents. THEY ARE BOTH RESPONSIBLE FOR THIS FRAUD! This precious little child didn\'t earn this money on his own at the local steelmill, drive his BMW to the competition, pay for his accommidations with his platnimun Visa or Mastercard, umm I think maybe, just maybe his parents not only funded him but enabled him to do this. This fradualent little tike has to bear some of the burden for his own actions since no one reported this child being held at gunpoint while entering this mini in the competetion, but the majority of blame falls on his parents who forgot that parenting doesn\'t end after conception and along with pro atheletes, parents too are role models!!! (Or at least they should be..) If he were my child he would not be \"bearing\" any weight on his butt for a while..but hopefully I have taught my son to be honest. Parents should teach their children right from wrong, and yes all you liberals out there, there is a difference between right and wrong!!! Thanks to all the CMON members for keeping an eye out for his next acquisition from eBay, if he starts bidding on any printing equipment, I would suggest an anonymous call to the FBI or Royal Police...

Of course that\'s just my opinion, I could be wrong...

Yeah, but...

Nice thoughts Braveheart. I agree parents are rolemodels but most are p***poor. How many parents (including some on this list) steal music over the internet, steal satellite signals or cable, copy VHS tapes, rip music onto mp3s, burn cds, games or DVDs?

The thing that p***es me off the most about parents is how they spend so much time complaining about athletes (i.e. those American Olympians who all cheated with drugs but have not lost their medals) or politicians but steal everyday. Especially now when computers and the internet have made theft an accepted daily occurance in many, many households. In fact most kids today that have grown up on the net don\'t really grasp that this stuff is theft-exactly the same type of theft as Golden Daemon fraud.

Did that kid do anything his parents don\'t do? Likely not. Maybe not EXACTLY the same thing but I guarantee Ma and Pa have illegal cd\'s or VHS tapes in the house.

You are missing the point, I think

Jim G.- While I agree with you about the behaviors that you mentioned are wrong, you are missing the point. Yes nearly everyone has done something wrong in their life, from breaking the speed limit when they are rushing to work, to looking at someones answers on a test, to crosssing the street outside of a crosswalk, etc, but people are responsible for their actions regardless of the actions of others. The excuses that \"he did it too\" or \"but he did this\" may have worked when you were five but as an adult you we should know better. I agree that Ma and Pa to this little tike are probably candidates for the next episode of Jerry Springer and that junior would probably be better raised by wolves, but in no way is this any sort of excuse for the wrong that was committed. Again each and every person has their own sins to atone for, and in no way does one person\'s shortcomings excuse anothers. And a s far as athletes go, I am my son\'s role model, not some overpaid, under educated, drug using, morally bankrupt jock whose only talent is throwing a ball in a hoop. I watch sport with my son, played both high school and college sports also, but I have taught my son that you can admire and enjoy someone\'s talent but that should be seperate from your admiration of the person unless that person earns your complete respect with his or her actions on and off the field of play. Lance Armstrong is one that comes to mind that exhibits class wherever he is while Kobe, A.I., Dennis Rodman, Randy Moss, John Rocker, Wade Boggs, The Portland Trailblazers, etc ( list WAY too long to continue) are the all too common rule that have talent on the court but off the field are an utter joke as a person.

Of course that is just my opinion, I could be wrong....

man, i\'m glad jim g doesn\'t live in Texas, as he\'d probably shoot us all, as were all thieves :|~ get real jim.

i guess by your last post jim, you are without sin?? let ye who cast the first stone......

man, lighten up. just becasue one set of parents didn\'t take the time to teach their kids right from wrong doesn\'t mean all are bad.

if this were the case, we\'d be able to blame ben johnson as the example for cheating olympians now couldn\'t we

Very eloquently put....

Braveheart, there is no way I could improve on the way you have stated the case. My views exactly.:D

So, to recap, this kid actually did two wrong things:

1.- Mangled Pity\'s mini, by putting it onto a real ugly stone.

2.- Cheated the GD\'s by entering it as his own work.

From the two offenses, I think that the second is the only one that could be prosecuted legally, and by GW only, since they are the ones cheated into giving an award (and that costed them money, not counting the loss of face).

Personally, the first offense bothers me more, since the youth mangled a fine piece of work, but any lawyer worth his salt would try and say that the re-basing itself would give enough cause to consider the finished piece as a different original work, that may or may not be expanding upon the original piece by Pitynoman.

Common sense would say this is ludicrous, but with lawyers you never know...

yeah gw should \"go after\" them like they always threaten. my good friend in nyc got a \"cease and desist\" for work he was doing on his site, they claimed \"IP\".

it \"seems\" if Pity had the ip clause attached to the auction he should be able to pursue breach #1. with all the coverage it\'s not like it could be covered up.

i still say there is no way to cover a miniature artist IP when goods are sold over the net. no legal precedence currently exisits in regards to painted miniatures.
