sorry so many posts but one more point. The topic of discussion is the actual case. my only issue is that the only thing that has been proven is that the guy is an a$$whole POS. he cheated on his wife and for lack of a better turn started a new life with another woman. he hasnt even been found guilty yet but from some of the media coverage you would think he had been tried and sentenced already. the media spin on any story can make or break an issue. they hold entirely too much power over the public. look at the case that they put Oprah Winfrey on the jury. All of a sudden this is a huge case. we the average person wouldnt even know the trial was going on if she wasnt on the jury.how many murder trials go on daily without public knowledge.

It is a little know fact here at CMON but believe it or not I hold a four year degree in criminal justice, so with that in mind, I do believe I am qualified to share some information with you...

The cost of incarceration is multi facated, they are the initial cost of law enforcement, followed by the court cost, coupled with the actual costs involved in incarceration including staff and facility maintenence, then upon release the cost of probation and follow up. These costs are high and burden innocent tax payers monitarily. All too often in this country criminals recitivate, that is commit the same or similar crimes upon release. What the death penalty does is prevent recitivism, that is removing the potential for this individual to commit their \"brand\" of crime again upon release. Many crimes, sexual crimes in particular have a recitivism rate in excess of 90%. Murder and manslaughter recitivism rates, while not this high, are still higher than zero, the only acceptable recitivism rate that would permit release back in society, in my opinon. It is our responsibilty to keep these individuals seperate from society so they cannot further infect the general populus. If these individuals are returned and the crimes continue, who is to blame?Answer, the we are and the \"fix\" is to keep these individuals seperate. Many things in life are cost based, and in todays struggling economic times it is not cost effective to keep alive individuals that have nothing left to offer society other than more pain and suffering. You may think killing is barbaric and medival, but it is a punishment that should be carried out to protect society and all the good individuals in it. There are consequences to our actions in life, and by breaking the laws in our land you should have to pay the penalty, no matter how harsh it may seem. Again, your god may offer you salvation and forgiveness for your crime, but here on earth you must pay the price for your transgressions...

As for the death penalty do we have the right to kill someone who has proven that they are a danger to society?
No , we have the responsibility to make sure that this person can never be a danger again.
The only 100% method is death.

When I was stationed in California back in the 90\'s. There was this guy who got out of prison.

This man would kidnap women, rape and torture them, then chop off their limbs and leave them in the wilderness to die.
He did this 6 times. The last of the 6 survived and they caught the guy.

10 years later he\'s out on good behavior, he does it again.

Now, who is responsible?
In my eyes the original judge who did not give him the death penalty, and the prison system for releasing him.
How would you feel being one of the parents/husbands/boyfriends of those girls to know that he was let out to torture, rape and kill again?

How would you feel to be the girl who survived, knowing that the guy who raped you, tortured you and left you crippled for the rest of your life got out and did it to someone else?

How would you feel to be the parents/husband/boyfriend of the latest girl, knowing that if they had put him down 10 years before you would still have your loved one?

Me, If someone did that to my fiance/kid, there would be no force on Heaven, Hell, or Earth that could stop me from taking him down, not merely for vengeance but also because I would not want someone else to go through that pain and loss when it could be prevented.

I wholeheartedly agree with the logic of what you say Braveheart, unfortunately the Criminal Justice systems in both of our countries are more than slightly fallible.....:(

Ugh... This trial is in my neck of the woods. I bet he walks. The prosecution is shit. Utter shit. I think the best they could hope for at this point is a hung jury...

Spacemunkie, I do agree that there is some error inherent in our justice systems and that there is nothing created by man that is perfect, however our system in this country has swung so far left that punishment is no longer a consideration, and far too often the rights of the victim are never an issue. Here in this country we have taken so many steps to safeguard the rights of the accused that we are afraid to enforce punishment. This is my opinion, but as you can tell I believe it with all my heart, just as I hope and pray that the twelve individuals deciding the fate of Scott Peterson do the right thing and keep the image of Lacy and her unborn child in their hearts when they decide the fate of Mr. Peterson.

I hope you are not correct, since Scott Peterson\'s defense has more holes in it that all the donuts at Krispy Kreme, but all it take is one bleeding heart liberal afraid of the death penalty to hang a jury.

Nawh, I don\'t think it will take one \"bleeding liberal heart\", I think it\'ll take one person who doesn\'t like killin\' people. Suprisingly, it\'s a fairly common emotion, even in cases like this.

For Amber Frey, single mom, caught up in this, being called a slut and worse, when she was used and manipulated.
She\'s had all kinds of offers for interviews, photo shoots, she turned them all down, all she want\'s is her privacy.

Since we\'re on the justice system, let me add 2 cents. The problem isn\'t only death penalty vs. \"o no you can\'t do that, he\'s a human being too !\" (which I find a debateable viewpoint). I\'ve met a few lawyers, and taken a few law classes from them. I was appalled at their mentality. All of them (that would be 3) did not really care whether their client was innocent or not. They didn\'t want to find facts, and counter-evidence, and such - like they show you on TV. Nope, they focused on administrative mistakes : \"oh, offices Shmoe didn\'t sign at the right place at the right time. Tough luck, my client is free because the instruction wasn\'t carried out properly.\" Another favourite : \"My client is mentally ill, you cannot jail him. He will go to an institution and get out in five years because his being a murderous b*stard doesn\'t keep him from being able to behave in front of a doctor.\"

I certainly don\'t suggest that lawyers just walk away from some of their clients. Their job is to do thair damnedest to protect him. I only wish everybody made a distinction between \'proving the client innocent (or at least keeping him from being proved guilty)\', and \'ensuring that he walks free\'. Drop the administrative nitpicking, guys, this is life and death we\'re talking about !

You\'re talking about killing people to save money, you say it costs you 8000 dollars per day, but I doubt that is true, i even doubt you make 8000 per day, the truth is taht it costs you maybe a 100 dollars a year to keep people alive. I don\'t believe in god but I really don\'t think it is your role to decide when sombodys life should end.
